A Mount Pleasant lawmaker authored HB 1788, a bill that if passed would provide immunity from liability for school security. The bill just passed its second reading in the Texas House on Monday.
“Liability concerns have been an impediment to schools wishing to take advantage of every available security option,” the bill’s author, Cole Hefner, said, “and this bill would help address those concerns.”
The bill would give immunity to security personnel at any Texas school – public or private – from damages when “reasonable action taken by security personnel to maintain the safety of the school campus, including action relating to possession or use of a firearm.”
The bill says the security personnel – paid or volunteer – would be immune from liability given they have written permission from the board of trustees to carry a firearm on campus.
During the preliminary votes, there were 89 votes in favor and 54 votes against the bill.
If passed, the law would take effect with the 2021-22 school year, or immediately if it receives a vote of two-thirds of all the members elected to each house. However, if it does not receive the two-thirds vote, it would take effect on Sept. 1, 2021.
